Captain America actress, Mollie Fitzgerald accused of stabbing her mother to death told law enforcement officials that she acted in ‘self defense’ according to court records.
Mollie Fitzgerald, 38, who appeared as Stark Girl in 2011 Marvel Film Captain America: The First Avenger, is charged with fatally stabbing Patricia ‘Tee’ Fitzgerald, 68, at her home in Olathe, Kansas on December 20.
Mollie Fitzgerald claimed that Patricia Fitzgerald had tried to kill her when she called 911 on Dec. 20 to report the fatal stabbing. But Patricia‘s autopsy, found no evidence to support the actress’ ‘self-defense’ claims as no signs were found that the elder Fitzgerald ever controlled the knife and that she suffered ‘defensive injuries’.
Fitzgerald who told a judge that she intends to represent herself in court told authorities that her mother had attacked her with a knife and that she hit her with a vacuum part to disarm her. During the struggle, Fitzgerald claims she grabbed the knife and stabbed her mother.
“(Fitzgerald) said her mother just would not stop trying to take the knife to kill her, so she had to kill her mom,” the arrest affidavit reads.
After the fatal incident, Fitzgerald who was arrested at the scene, was taken to hospital, where she was treated for minor injuries and a bite mark on her bicep.
Fitzgerald had been staying with her mother at a home in Olathe since June. Her father told the police that her “aggressive behaviors” had been escalating since that time and that he and Patricia Fitzgerald would leave the room when the outbursts occurred.
However, a medical examiner revealed that Patricia had suffered ‘defensive wounds’ in the attack and bruising on her face and neck that appeared to indicate attempted choking. She also had multiple wounds on her hands, including one that almost severed her thumb.
Fitzgerald who was arrested on December 31 and charged with second degree murder is set to return to court on Jan. 29.
